Terms & Conditions governing the 500-Hour Residential Fellowship, Sponsored Training & Service Commitment.

YOGA TEACHER TRAINING PROGRAMME

TERMS & CONDITIONS

These Terms & Conditions apply to the Yoga Teacher Training Programme conducted by SHIV SATTVA YOGA (“Centre”). By applying for, enrolling in, or participating in the Programme, the applicant/trainee acknowledges that they have read, understood and agreed to comply with these Terms & Conditions.

1. PROGRAMME DURATION

The Yoga Teacher Training Programme is a structured programme of approximately six (6) months / 180 days, including holidays, subject to the Centre’s academic schedule and the trainee’s satisfactory completion of the prescribed requirements.

The Programme may include theoretical education, practical yoga training, teaching methodology, demonstrations, assessments, assignments, supervised teaching practice, attendance requirements, discipline and other components reasonably prescribed by the Centre.

A significant portion of the Programme may consist of practical, client-facing training. During such practical training, trainees may be required to conduct yoga classes and provide supervised yoga teaching services to the Centre’s students or clients as part of their training.

2. ADMISSION AND ELIGIBILITY

Admission is subject to the Centre’s selection and approval process.

The trainee must provide accurate and complete information during the admission process. Any material misrepresentation, concealment of relevant information or submission of false documents may result in cancellation of admission or discontinuation from the Programme, subject to applicable law.

3. SPONSORED TRAINING

Under the applicable sponsored training arrangement, the Centre may sponsor or arrange certain expenses for the trainee during the Training Period.

These may include:

  • Course fees
  • Accommodation/rent
  • Food
  • Mineral water
  • Travelling expenses, subject to applicable limits and conditions
  • Other expenses specifically approved by the Centre

The trainee may not be required to pay the ordinary Course Fee upfront during the Training Period, subject to the terms of the applicable signed agreement.

The Centre may prescribe reasonable rules, limits and conditions regarding sponsored facilities.

4. ACCOMMODATION AND DISCIPLINE

Where accommodation is provided or arranged by the Centre, the trainee must maintain proper cleanliness, hygiene, discipline and appropriate conduct.

The trainee must take reasonable care of the accommodation, furniture, fixtures, equipment and other property provided by the Centre.

Wilful or negligent damage to Centre property may result in disciplinary action and/or recovery of the actual loss or damage, subject to applicable law.

Where the trainee is residing in Centre-provided accommodation or is required to remain on Centre premises as part of the Programme, prior permission from management may be required before leaving the premises for market visits, personal work, outings or leave, except in genuine emergencies.

5. ATTENDANCE AND PARTICIPATION

Trainees are expected to attend the Programme regularly, punctually and sincerely.

Trainees must comply with reasonable academic, administrative, safety, professional and disciplinary requirements of the Centre.

Completion of the six-month period does not automatically constitute successful completion of the Programme. Successful completion is subject to applicable attendance, assessment, conduct, practical performance and other requirements prescribed by the Centre.

6. HEALTH AND MEDICAL DISCLOSURE

Before commencement of the Programme, trainees must truthfully disclose any existing health condition, injury, allergy, physical limitation, relevant medical history or ongoing medication that may reasonably affect their participation, practical training, assigned duties or accommodation.

The Centre may require reasonable medical or health reports for legitimate health and safety purposes.

If any illness, injury or health-related issue arises during the Programme or subsequent Service Period and materially affects the trainee’s ability to participate or perform assigned duties, the trainee must promptly inform the management.

7. INITIAL FIFTEEN-DAY WITHDRAWAL PERIOD

The trainee shall have an initial period of fifteen (15) calendar days from the date of joining to assess the Programme, its requirements, facilities and suitability.

If the trainee decides not to continue during this period, the trainee may withdraw by providing written notice to the Centre.

Withdrawal within this initial period will ordinarily release the trainee from the Minimum Service Commitment applicable after successful completion of the Programme and commencement of employment/service.

This does not affect any liability relating to Centre property, fraud, wilful misconduct, damage, independently recoverable expenses or any other independent breach, subject to applicable law.

8. WITHDRAWAL AFTER FIFTEEN DAYS

If a trainee voluntarily withdraws from or abandons the Programme after expiry of the initial fifteen-day period, without material breach or default attributable to the Centre, the trainee may be required, subject to applicable law, to reimburse the actual and reasonable Sponsored Expenses incurred or irrevocably committed by the Centre for and on behalf of the trainee up to the effective date of withdrawal.

The Centre may provide a statement setting out the basis of any amount claimed.

9. SUCCESSFUL COMPLETION AND CERTIFICATION

Upon successful completion of the Programme, the Centre may issue a certificate or other document evidencing completion, subject to the Centre’s applicable standards and requirements.

Completion and certification are subject to satisfactory attendance, assessments, conduct, practical competence and other prescribed requirements.

10. POST-TRAINING EMPLOYMENT / SERVICE OPPORTUNITY

Subject to successful completion of the Programme, satisfactory performance, suitability and availability of a suitable position, the Centre may offer the trainee an opportunity to work with SHIV SATTVA YOGA as a Yoga Teacher, Instructor or in another appropriate role mutually agreed upon by the parties.

The applicable employment/service terms, remuneration and duties may be further specified in the appointment letter or employment/service agreement.

The Programme itself does not guarantee a particular position or remuneration irrespective of performance, suitability or availability.

11. MINIMUM SERVICE COMMITMENT

Where the trainee successfully completes the Programme and commences employment/service with SHIV SATTVA YOGA pursuant to the applicable arrangement, the trainee undertakes to provide services to the Centre for a minimum period of two (2) years from the date of commencement of such employment/service.

This Minimum Service Commitment forms part of the sponsored training arrangement because the Centre makes substantial professional and financial investment in the trainee’s training and related expenses.

The Minimum Service Commitment is intended to regulate the contractual service relationship and is not intended to prohibit the trainee from carrying on any lawful profession, occupation or business after cessation of the contractual relationship.

12. PREMATURE VOLUNTARY CESSATION OF SERVICE

If, after commencement of employment/service, the trainee voluntarily resigns, abandons employment/service or otherwise voluntarily ceases to provide services before completion of the Minimum Service Period, such premature cessation may constitute a breach of the applicable contractual commitment.

Subject to applicable law, the Centre may claim reimbursement or compensation in respect of the unrecouped portion of Sponsored Expenses actually incurred for the trainee and any other legally recoverable loss or compensation.

13. RECOVERY OF UNRECOUPED SPONSORED EXPENSES

Where legally permissible and reasonably appropriate, the unrecouped portion of Sponsored Expenses may be calculated on a proportionate basis using the following formula:

Unrecouped Sponsored Expenses = Actual Recoverable Sponsored Expenses × Remaining Service Period ÷ 24 Months

The applicable amount shall remain subject to the actual expenses incurred, the terms of the signed agreement and applicable law.

Nothing in these Terms & Conditions shall be interpreted as creating an unlawful penalty or preventing a competent court or authority from determining the amount legally recoverable.

14. RESIGNATION AND NOTICE PERIOD

During the Minimum Service Period, a trainee who wishes to voluntarily resign shall provide a minimum of three (3) months’ prior written notice, unless a shorter period is expressly accepted by the Centre in writing.

During the notice period, the trainee shall continue to perform assigned duties and cooperate with the Centre for an orderly transition.

Before cessation of service, the trainee shall properly hand over assigned classes, clients, students, schedules, records, teaching responsibilities and other work-related matters to the person designated by the Centre.

15. CONFIDENTIALITY

During the Programme and Service Period, trainees may have access to confidential information relating to SHIV SATTVA YOGA, including:

  • Student and client information
  • Contact details
  • Client records
  • Pricing and commercial arrangements
  • Training materials
  • Teaching systems
  • Schedules
  • Internal procedures
  • Business information
  • Operational information

Such information must not be disclosed, copied, transferred, published, misused or commercially exploited without proper authorisation.

These confidentiality obligations may continue after cessation of the contractual relationship to the extent permitted by applicable law and for so long as the information remains confidential and legally protectable.

16. STUDENT AND CLIENT PROTECTION

Trainees must maintain confidentiality regarding the personal and professional information of the Centre’s students and clients.

Trainees must not misuse the Centre’s confidential client database, contact information, records or professional relationships for personal or competing business purposes.

During the Course and Service Period, and thereafter to the extent permitted by applicable law, trainees must not use confidential client information obtained through the Centre to directly or indirectly solicit, divert or induce a Centre client/student to discontinue or reduce their association with the Centre for the purpose of providing private, independent or competing yoga/training services.

Nothing in these Terms & Conditions is intended to impose a general prohibition on lawful yoga practice or professional activity after cessation of employment/service.

17. TRAINING MATERIAL AND INTELLECTUAL PROPERTY

Training manuals, teaching materials, lesson plans, recordings, videos, formats, systems, written content and other proprietary materials supplied by or belonging to SHIV SATTVA YOGA shall remain subject to the Centre’s applicable ownership and intellectual-property rights.

Trainees shall not reproduce, sell, commercially distribute, publish or otherwise commercially exploit such proprietary material without prior written permission from the Centre.

Nothing in these Terms & Conditions prevents a trainee from using general knowledge, skills and experience lawfully acquired through the Programme.

18. CENTRE PROPERTY

All books, equipment, documents, access devices, training materials and other property belonging to the Centre shall remain the property of SHIV SATTVA YOGA.

Such property must be returned upon withdrawal, termination or cessation of employment/service.

The Centre may pursue remedies available under applicable law in respect of wilful or unauthorised retention, misuse or damage of Centre property.

19. PROFESSIONAL CONDUCT

Trainees are required to maintain professional, respectful and disciplined conduct throughout the Programme and Service Period.

Serious misconduct may include, but is not limited to:

  • Violence or fighting
  • Harassment or intimidation
  • Theft
  • Fraud
  • Serious disciplinary violations
  • Persistent non-attendance
  • Wilful damage to Centre property
  • Serious insubordination
  • Material misrepresentation
  • Other material breaches of the applicable agreement

Depending on the circumstances and applicable law, the Centre may take appropriate disciplinary action, including warning, suspension, discontinuation of training or termination of employment/service.

20. FALSE OR MISLEADING INFORMATION

Knowingly making, publishing or circulating false or materially misleading information concerning SHIV SATTVA YOGA, its management, staff, trainers, students, clients or services, with the intention of causing reputational or commercial harm, may constitute a material breach of the applicable agreement.

Nothing in these Terms & Conditions restricts a person from making a truthful complaint, reporting unlawful conduct or exercising any legal right available under applicable law.

21. TERMINATION / DISCONTINUATION

The Centre may discontinue a trainee’s participation in the Programme in cases of serious misconduct, fraud, material misrepresentation, persistent non-attendance, serious disciplinary violations, fighting or violence, harassment, intimidation, theft, wilful property damage, serious insubordination or other material breach, subject to applicable law.

Any such action may be recorded in writing.

22. FORCE MAJEURE

Neither party shall be liable for failure to perform an obligation to the extent that such failure results from circumstances beyond reasonable control, including natural calamity, governmental restrictions, war, epidemic, civil disturbance or other circumstances recognised under applicable law.

23. AMENDMENTS

The Centre reserves the right to make reasonable amendments to Programme schedules, procedures, administrative requirements and operational rules where necessary.

Any amendment to a signed contractual agreement shall be made in accordance with the terms of that agreement and applicable law.

24

24. GOVERNING LAW

These Terms & Conditions and the applicable Programme arrangement shall be governed by the laws of India, subject to applicable law.

Any dispute shall initially be attempted to be resolved through good-faith discussion between the parties.

Where a dispute cannot be resolved amicably, the parties may pursue remedies available under applicable law.

25. IMPORTANT NOTICE

These website Terms & Conditions provide general information regarding the Yoga Teacher Training Programme.

Where a trainee enters into a separate written Yoga Teacher Training and Service Commitment Agreement with SHIV SATTVA YOGA, the signed agreement shall govern the specific rights, obligations, sponsored expenses, service commitment and other contractual matters between the parties, subject to applicable law.

By submitting an application or participating in the Programme, the applicant/trainee acknowledges that they are expected to read and understand these Terms & Conditions and any applicable admission or contractual documents before joining the Programme.
